Rushville City Council Minutes September 30, 2013

The meeting was called to order by Mayor Chris Heiser at 7:00 p.m. as per the Municipal Code of the City of Rushville, Sheridan County, NE. Notice of the meeting was given by publication in the Sheridan County Journal Star on September 25, 2013 as required by law and delivered to the Council in person. Present: Snyder,Willnerd, Janssen.

The following motions were duly made, seconded and passed.

1. To approve, accept and ratify the following items listed under the consent agenda: Council minutes of the August meeting, the August Treasurers Report.

2. Approved Special Liquor License for 20 Bar for Rushville Rancher Roundup on October 19, 2013.

3. Approved Special Liquor License for Yoba’s Tavern for Rushville Rancher Roundup on October 19, 2013.

4. Approved renewal of City Insurance from Security First Insurance.

5. Approved adoption of Ordinance #13-769 an ordinance authorizing the requirement of a deposit for water accounts and codifying when such deposits shall be refunded; what shall happen upon relocation of the customer and/or upon disconnection of water services for nonpayment; and an effective date.

ORDINANCE NO. 13-769

AN ORDINANCE OF THE CITY OF RUSHVILLE, NEBRASKA, AUTHORIZING THE REQUIREMENT OF A DEPOSIT FOR WATER ACCOUNTS AND CODIFYING WHEN SUCH DEPOSITS SHALL BE REFUNDED; WHAT SHALL HAPPEN UPON RELOCATION OF THE CUSTOMER AND/OR UPON DISCONNECTION OF WATER SERVICE FOR NONPAYMENT; AND AN EFFECTIVE DATE. 

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF RUSHVILLE, NEBRASKA: 

SECTION 1. DEPOSIT REQUIREMENT FOR WATER SERVICE ACCOUNTS. All individuals or entities wishing to open a City water account shall pay a deposit to the City in the amount of One Hundred Dollars ($100.00) prior to commencement of water service. 

SECTION 2. REFUND OF DEPOSIT. The deposit shall be refunded to the customer upon cancellation of the account, or after two years, provided that all bills have been paid in full and no checks have been returned unpaid. If the deposit is being refunded due to cancellation of an account, the remaining balance due on the date service is terminated will be deducted from the deposit.

SECTION 3. RELOCATION OF CUSTOMER. Deposits of customers who have existing city water accounts will be applied to the customer’s new account in the event that the customer relocates to another location within the City during the two-year period, provided that all bills have been paid in full and no checks have been returned unpaid. Current city water customers who were residents before this ordinance was enacted and who move to another address within the city will not be required to make a deposit prior to receiving water service at their new address, provided that all bills have been paid in full and no checks have been returned unpaid.

SECTION 4. DISCONNECTION FOR NONPAYMENT. In the event a customer’s water account is disconnected for nonpayment, the entire deposit shall be applied toward the delinquent water account. Any outstanding debt in the water account may thereafter be pursued by the City as provided for in the Rushville Municipal Code, Ordinance 3-112. Customers whose service has been disconnected for nonpayment will be required to make a new deposit of One Hundred Dollars ($100.00) prior to receiving service, regardless of whether the customer was required to pay a deposit in the past or had a deposit refunded to them. 

SETION 5. WHEN OPERATIVE. This ordinance shall be in full force and take effect from and after its passage, approval, and publication or posting as required by law.

The Law Enforcement contract was discussed. Councilman Willnerd would like to renegotiate the law contract with the County Sheriff and the County Commissioners, and asked that the City Clerk contact the County Clerk and have them put on the County Commissioners agenda for October 21, 2013 and the Mayor and Councilman Snyder will attend the meeting. This was tabled at this time.

RV Sewer dump was discussed. The engineers can not give a quote on how much it would cost to put in a RV dump until the city finds a site for the dump. The City Clerk will try to find out who owns the property where the old rendering plant was. This was tabled at this time.

Reimbursement for the Walk/Bike Trail was discussed. The City Attorney will check and see the status on this. This was tabled at this time.

The City Boards will meet as follows: Ambulance Board October 08, 2013; Golf Board October 08, 2013; Library Board October 21, 2013.
