City of Rushville Resolution No. 2014-03

Council Member Matt Jansen introduced the following Resolution and moved for its adoption.

RESOLUTION NO. 2014-03

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF RUSHVILLE, NEBRASKA:

Section 1. The City currently has the power by ordinance to regulate traffic upon the streets, sidewalks and public places within the incorporated limits of the City pursuant to Neb. Rev. Stat. Sec. 17-139. 

Section 2. The City has enacted an ordinance pursuant to Section 17-139 in which to, by resolution provide for the placing of signs in any street or alley under the municipality’s jurisdiction for the purpose of regulating traffic thereon. 

Section 3. That said ordinance referenced in Section 2 is Rushville City Ordinance Section 5-103. 

Section 4. That it has come to the attention of the governing body of the need for such regulation of a certain alley within the municipality’s jurisdiction.

Section 5. That pursuant to said ordinance, the City hereby resolves that an alley located within the municipality’s jurisdiction - more specifically located directly east of the Security First Bank, 101 East 2nd Street, Rushville, Nebraska, and running south to north from East Third Street on the south to East Second Street on the north in Block Seven (7) within the municipality’s jurisdiction - shall hereby be a one way street and/or alley where vehicles will be permitted to only travel south to north. 

Section 6. That a sign regulating traffic in said alleyway as a one way street shall be placed at the intersection of the south end of said alleyway and east third street.

Section 7. That a sign regulating traffic in said alleyway as a one way street shall be placed at the intersection of the north end of said alleyway and east second street.

Section 8. That a sign regulating traffic in said alleyway shall be placed at the intersection of the north end of said alleyway and east second street which sign will be a do-not-enter sign. 

Section 9. That the signs aforementioned in Sections 6, 7 and 8 of this Resolution will be those signs permitted by the State of Nebraska pursuant to Neb. Rev. Stat. Sec. 60-6,118 and Title 411 Neb. Admin. Code Sec. 411-1-001.01.

Section 10. Such regulation of said alleyway shall become effective only after all of the aforementioned traffic signs giving notice of such local traffic regulation are erected upon or at the entrances to such affected alleyway pursuant to Neb. Rev. Stat. Sec. 60-680(3). 

The foregoing resolution having been read, council member Stephanie Lovell seconded the motion for passage and adoption, and after consideration thereof, the roll was called on the passage and the adoption of said resolution and the following council members voted aye: Brian Snyder, Stephanie Lovell and Matt Jansen. The following council members voted nay: none. The passage of the resolution having been consented to by more than a majority of the members elected to the council was declared passed and adopted this 27th day of October, 2014.
