Gordon Planning Commission Minutes April 14, 2016

Notice of the meeting was given to advance by publication in the Sheridan County Journal Star, the designated method for giving notice as shown by the affidavit of publication on file in the City Clerk’s office.  Agendas of the meeting were simultaneously given to the Chairman and all members of the Planning Commission.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

A meeting of the Planning Commission of the City of Gordon was called to order at 5:00 p.m., April 14, 2016 in the Council Chambers of the City Auditorium.  The Chairman noted the location of the Open Meetings Laws poster.

Present: Bounous, Muirhead, Larson, Meyer, Burleigh, Rucker, Metzger, Krasomil, and Liggett.

Absent:  No One.

City Manager Jacob Sheridan began the meeting with a review of the Blight Study done for the City of Gordon by the Panhandle Area Development District (PADD). Lawyer Michael Bacon, who is representing the City of Gordon, was present at the meeting to answer any questions and to clarify the process for the Tax-Increment Financing (TIF). In order for an area to be eligible for redevelopment and TIF, the area must first qualify as blighted and substandard. The study completed by PADD confirms that the area qualifies. The majority of buildings in the area are more than 40 years old, many buildings are in states of deterioration and some properties have debris and vegetation overgrowth that could be hazardous to the well-being of the citizens of Gordon. There were no comments for or against this study from the general public. After some discussion, motion by Krasomil, seconded by Larson, to approve Resolution 2016-PC1. Ayes: Bounous, Muirhead, Larson, Meyer, Burleigh, Rucker, Metzger, Krasomil, and Liggett.

Nays: No one.

RESOLUTION NO. 2016-PC1

PLANNING COMMISSION OF THE CITY OF GORDON

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GORDON, NEBRASKA, MAKING RECOMMENDATIONS WITH RESPECT TO A SUBSTANDARD AND STUDY FOR AN AREA PURSUANT TO THE NEBRASKA COMMUNITY DEVELOPMENT ACT.

WHEREAS, the Mayor and City Council of the City of Gordon, Nebraska, (the “City”) by its Ordinance created the Community Development Agency of the City of Gordon, Nebraska (the “Agency”) pursuant to Sections 18-2101 through 18-2154, Reissue Revised Statutes of Nebraska, as amended (the “Act”);

WHEREAS, the City has adopted and has in place a Comprehensive Plan, which includes a general plan for development of the City, within the meaning of Section 18-2110 of the Act;

WHEREAS, this Commission has received a study to determine whether an area should be declared blighted and substandard under the Act for purposes of review and recommendation pursuant to Section 18-2109 of the Act.

NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF GORDON, NEBRASKA, AS FOLLOWS:

RESOLVED, that the Planning Commission hereby makes the following findings with respect to the Substandard and Blight Study (the “Study”) prepared for the City by the Panhandle Development District:

1.  The Planning Commission has reviewed the Study (a copy of which is attached to this resolution as Attachment “A”) as to its conformity with the general plan for the development of the City as a whole; and

2.  The Planning Commission confirms that the area described in the Study meets the definition of blighted and substandard as set forth in the Act.

3.  The Planning Commission makes no other recommendation with regard to such Study.

RESOLVED FURTHER, that any Resolution passed and approved prior to the passage, approval and publication of this Resolution which is in conflict with the terms and provisions of this Resolution is hereby repealed.  This Resolution shall take effect and be in full force and effect from and after its passage, approval and publication as required by law.  The provisions of this Resolution are separable, and invalidity of any phrase, clause or part of this Resolution shall not affect the validity or effectiveness of the remainder of this Resolution.

City Manager Jacob Sheridan then reviewed with the commission the redevelopment plan presented by KTJ 283, LLC. Brian Smith, representative of KTJ, which is a subsidiary of Oppidan, was present to answer any questions regarding the proposed plan. After some discussion, motion by Krasomil, seconded by Rucker to pass Resolution 2016-PC2. Ayes: Muirhead, Larson, Meyer, Burleigh, Rucker, Metzger, Krasomil, Liggett, and Bounous. Nays: No one.

RESOLUTION NO. 2016-PC2

PLANNING COMMISSION OF THE CITY OF GORDON

Resolution Recommending Approval of a Redevelopment Plan of the City of GORDON, Nebraska; and Approval of Related Actions

BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF GORDON, NEBRASKA:

Recitals:

a. Pursuant to and in furtherance of the Community Development Law, Chapter 18, Article 21, Reissue Revised Statutes of Nebraska, as amended (the “Act”), a Redevelopment Plan (collectively, the “Redevelopment Plan”), has been prepared and submitted to the Planning Commission by the Community Development Agency (the “Agency””) of the City of Gordon, Nebraska and KTJ 283, LLC, (the “Redeveloper”), for the purpose of redeveloping the Redevelopment Area legally described in Exhibit A and in the form attached hereto as Exhibit B; and

b. The City has previously adopted and has in place a Comprehensive Plan, which includes a general plan for development of the City within the meaning of Section 18-2110 of the Act; and

c. This commission has reviewed the Redevelopment Plan as to its conformity with the general plan for the development of the City.

Resolved that:

1. The Commission hereby recommends approval of the Redevelopment Plan with such changes and revisions as are deemed appropriate by the Agency.

2. All prior resolutions of the Commission in conflict with the terms and provisions of this resolution are hereby expressly repealed to the extent of such conflicts.

3. This resolution shall be in full force and effect from and after its passage as provided by law.
