Gordon City Council Minutes Special Meeting, September 12, 2016

Notice of the special meeting was given in advance by publishing in the Sheridan County Journal Star, the designated method as shown by the affidavit of publication on file at the office of the City Clerk.  Agendas of the meeting were simultaneously given to the Mayor and all members of the Council.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

A special meeting of the City Council of the City of Gordon was called by City Manager Jacob Sheridan to address Resolution 2016-15, Ordinance 1164, and Resolution 2016-16. The meeting was called to order at 6:00 p.m., September 12, 2016 in the Council chambers of the City Auditorium.  The Vice-Mayor noted the location of the Open Meetings poster in the back of the room. The only agenda items for this meeting were Resolution 2016-15, Ordinance 1164, and Resolution 2016-16. 

Present:  Morgan, Grant, Bounous, and Evans.

Absent:   Russell.

The special hearing was opened by the Mayor at 6:01 pm and conduct of the meeting was turned over to the hearing officer, Jacob Sheridan. He explained and reviewed with the Council the request to adopt a property tax request for Fiscal Year 2016-2017, different than the prior year tax request. With no one present to offer testimony in favor or against the property tax request, the special hearing was closed at 6:02 pm. Motion by Bounous, seconded by Evans to pass Resolution 2016-15.  Ayes: Grant, Bounous, Evans, and Morgan.

RESOLUTION NO. 2016-15

WHEREAS, Nebraska Revised Statute 77-1601.02 provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of the levy set by the County Board of Equalization unless the Governing Body of the City of Gordon passes by a majority vote a resolution or ordinance setting the tax request at a different amount; and

WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request; and

WHEREAS, it is in the best interests of the City of Gordon that the property tax request for the current year be a different amount than the property tax request for the prior year.

NOW, THEREFORE, the City Council of the City of Gordon, Nebraska by a majority vote, resolves that:

1. The 2016-2017 property tax request be set at $234,371.83 for the General Fund and $17,000.00 for the Bond Fund; a total of $251,371.83.

1. A copy of this resolution be certified and forwarded to the County Clerk on or before October 13, 2016.

The budget hearing for the 2016-2017 Fiscal Year was opened at 6:03 pm. There were no changes to the budget since the budget workshop held on September 1, 2016. With no one present to offer testimony in favor or against the approval of the 2016-2017 budget, the special hearing was closed at 6:04 pm. Motion by Bounous, seconded by Evans to exceed the budget limit for the 2016-2017 Fiscal Year by an additional 1%.  Ayes:  Bounous, Evans, Morgan, and Grant.

Motion by Grant, seconded by Evans to pass Ordinance 1164. Ayes: Evans, Morgan, Grant, and Bounous.

ORDINANCE NO.  1164

AN ORDINANCE TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL; TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVIDE FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GORDON, NEBRASKA:

Section 1.  That after complying with all procedures required by law, the budget presented and set forth in the budget statement is hereby approved as the Annual Appropriation Bill for the fiscal year beginning October 1, 2016 through September 30, 2017.  All sums of money contained in the budget statement are hereby appropriated for the necessary expenses and liabilities of the City of Gordon.  A copy of the budget document shall be forwarded as provided by law to the Auditor of Public Accounts, State Capitol, Lincoln, Nebraska, and to the County Clerk of Sheridan County, Nebraska, for use by the levying authority.  The total budget of expenditures for all funds is $2,427,988.00 plus necessary cash reserves of $483,641.00 for a total of $2,911,629.00.  Total Unused Restricted Funds Authority $350,084.15.

Section 2. This ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.

Motion by Evans, seconded by Bounous to waive 2nd and 3rd readings of Ordinance 1164. Ayes: Morgan, Grant, Bounous, and Evans.As discussed at the Budget Workshop, the Gordon Police Department is in need of a new vehicle. To offset the cost of the vehicle, the city will make a $15,000 downpayment, using the money donated from the fund raiser done by the G/R High School and money from recent hail insurance claims on obsolete police vehicles. Motion by Evans, seconded by Grant to pass Resolution 2016-16. Ayes: Grant, Bounous, Evans, and Morgan.

RESOLUTION 2016-16

A RESOLUTION AUTHORIZING THE CITY OF GORDON TO SIGN A FINANCE AGREEMENT WITH SIDES & MILBURN FORD, RUSHVILLE, NE

WHEREAS, the majority of the City of Gordon’s fleet of police vehicles have mileage in excess of 100,000 and are reaching the end of their useable life, and

WHEREAS, the City of Gordon must update the fleet of police vehicles to enable the City of Gordon police officers to fulfill their duties, and

WHEREAS, the City of Gordon received the most favorable bid from Sides & Milburn Ford, Rushville, NE for a 2017 Ford Explorer (Police Package).

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF GORDON, to authorize the City Manager to signature the Equipment Financing Contract with Sides & Milburn Ford, Rushville, NE.
