AN ORDINANCE OF THE CITY OF RUSHVILLE, NEBRASKA PROHIBITING THE INSTALLATION AND MAINTENANCE OF WATER SERVICE CONNECTION TO PREMISES WHERE LEAD BASED MATERIALS WERE UTILIZED AFTER A CERTAIN DATE; REMEDY FOR VIOLATION; PROVIDING AN EFFECTIVE DATE:
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF RUSHVILLE, NEBRASKA:
Sec. 1. Sec. 3-128 of Municipal Code of Rushville, Nebraska, is hereinafter enacted to read as follows:
WATER SERVICE CONNECTION BAN.
A. No water service connection shall be installed or maintained to any premises where lead based materials were used in new construction or modifications of the drinking water plumbing after January 1, 1989.
B. If a premises is found in violation of subsection A above, water service shall be discontinued until such time that the drinking water plumbing is lead free. Nothing contained herein shall limit the City’s remedy as otherwise provided by statute, law or ordinance.
Sec. 2. Any other ordinance section passed and approved prior to passage, approval and publication or posting of this ordinance and in conflict with its provisions are repealed.
Sec. 3. This ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.
