Gordon Special Meeting Minutes, October 22, 2018

Notice of the special meeting was given in advance by publishing in the Sheridan County Journal Star, the designated method for giving notice as shown by the affidavit of publication on file in the City Clerk’s office. Agendas of the meeting were simultaneously given to the Mayor and all members of the Council. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

A special meeting of the City Council of the City of Gordon was called by City Clerk Kim Buchan for the purposes appointing an Interim City Manager, appointing a primary representative to the Solid Waste Agency of Northwest Nebraska, and Ordinance 1181. The meeting was called to order at 6:00 p. m., October 22, 2018 in the Council chambers of the City Auditorium. The Mayor noted the location of the Open Meetings poster in the back of the room. The only agenda items for this meeting were appointing an Interim City Manager, appointing a primary representative to the Solid Waste Agency of Northwest Nebraska, and Ordinance 1181.

Present: Russell, Grant, Bounous, and Evans.

Absent: Paul.

After some discussion regarding suitable candidates for Interim City Manager, motion by Bounous, seconded by Grant to appoint Public Works Director Dan Bishop as the Interim City Manager. Ayes: Grant, Bounous, Evans, and Russell.

Motion by Grant, seconded by Bounous to appoint Deputy City Clerk Glen Spaugh as the Primary Representative to the Solid Waste Agency of Northwest Nebraska. Ayes: Bounous, Evans, Russell, and Grant.

Motion by Grant, seconded by Evans to pass Ordinance 1181. Ayes: Evans, Russell, Grant, and Bounous.

ORDINANCE NO. 1181

AN ORDINANCE OF THE CITY OF GORDON, NEBRASKA, PROVIDING FOR CONFIRMATION OF THE SALE OF CERTAIN REAL ESTATE OWNED BY THE CITY

WHEREAS THE CITY OF GORDON NEBRASKA is the owner of certain real property more specifically described as: 

A tract of land located in Outlot “F” of the SW1/4 of Section 25, Township 33 North, Range 42 West of the 6th P.M., Sheridan County 

Nebraska, more particularly described as follows: Commencing at the Northwest corner of said Outlot “F”; thence S89º59’E along the north line of said Outlot “F”, for 1030.46 feet, thence S 0 º01’ W, for 40.0 feet to the point of beginning; thence S 0º 01’ W for 50.00 feet; thence N 89º 59’W for 50.00 feet; thence N0º 01’E, for 50.00 feet; thence S89º 59’ E, for 50.00 feet to the point of beginning. Said tract contains 0.06 acres, more or less. 

WHEREAS RESOLUTION NO. 2018-20 was previously passed and approved on the 6th day of August, 2018 wherein the CITY gave notice of the offer of sale of the aforedescribed property to STEPHEN SANDERS, and thereafter posted notice of the proposed sale including terms and conditions of the sale; 

WHEREAS RESOLUTION NO 2018- 23 was thereafter passed and approved on the 11th day of October, 2018, correcting the legal description of the property to be sold to STEPHEN SANDERS;

WHEREAS the property proposed for sale had a total fair market value less than $5,000.00; 

WHEREAS the notice of property sale was posted in three (3) prominent public places within the CITY prior to the sale of the property; 

WHEREAS the conditions of the proposer for sale as identified in Resolution 2018-20 and Resolution 2018- 23 have been completed; 

WHEREAS the CITY COUNCIL FOR THE CITY OF GORDON has approved the sale of the aforedescribed real estate to STEPHEN SANDERS upon the terms and conditions as laid out in Resolution 2018- 20, and corrected by Resolution 2018-23;

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF GORDON, NEBRASKA:

SECTION 1. The Mayor and Council of the City of Gordon, Nebraska, hereby approve the sale of:

SECTION 2. The Mayor and City Clerk are hereby authorized and empowered to execute and deliver a Warranty Deed to STEPHEN A. SANDERS and DIANA D. SANDERS, Husband and Wife, on behalf of the City of Gordon.

SECTION 3. This ordinance shall take effect and be in full force from and after its passage, approval, and publication as required by law.
