RESOLUTION #18- 05 RESOLUTION OF SUBDIVISION APPROVAL November 26, 2018

WHEREAS, Application has been made for Subdivision Approval of certain property located in the Southwest Quarter Section 26, T. 32 North, Range 44 West of the 6th P.M., Sheridan County, Nebraska, within the extra territorial zoning jurisdiction of the City of Rushville, Nebraska;

WHEREAS, the record owners of said property wish to convey and subdivide a certain portion of the aforementioned real property to Grantees, Donald A. Linders and Lynnette E. Linders;

WHEREAS, the subdivision is more specifically described as follows:

A tract of land located in the Southwest Quarter of Section 26, Township 32 North, Range 44 West of the 6th P.M., Sheridan County, Nebraska, more particularly described as follows:

Commencing at the South quarter comer of said section; thence N 21° 28’45” W for a distance of 1637.87 feet to a pipe at the northeast corner of Lot 7 of Dobry’s Second Addition to the City of Rushville, Nebraska, and a point of beginning; thence N88°09’14” W for a distance of 74.94 feet along the North line of said Lot 7 to the Southeast corner of Lot 6 of said addition; thence N0l°48’23” E for a distance of 242.68 feet along the East line of said Lot 6 to the Northeast corner of said Lot 6; thence N81°04’53” E for a distance of 76.52 feet; thence S01°51’38” W for a distance of 256.96 feet to the point of beginning.

WHEREAS a survey of the foregoing real estate has been prepared by the record owners, and a copy of such survey is attached hereto and marked Exhibit “A”;

NOW, THEREFORE, be it resolved, that the City Council for the City of Rushville does hereby approve and grant permission for the subdivision of the foregoing real estate and does hereby approve the survey attached hereto as Exhibit “A” to be filed of record along with this Resolution and made a part of the record of such real estate such that the Sheridan County Clerk shall have the power and right to receive a deed of such property and record the same of record as may be required at the time.
