CITY OF RUSVHILLE ORDINANCE #20-799

AN ORDINANCE RELATING TO REGULAR MEETINGS OF THE CITY COUNCIL OF THE CITY OF RUSHVILLE, NEBRASKA; TO CHANGE THE QUORUM REQUIREMENTS PURSUANT TO STATE STATUTE WHICH ALLOWS FOR THE MAYOR TO BE DEEMED A MEMBER OF THE CITY COUNCIL FOR PURPOSES OF ESTABLISHING A QUORUM; TO PROVIDE AN EFFECTIVE DATE. 

Be it ordained by the Mayor and Council of the City of Rushville, in the County of Sheridan, State of Nebraska: 

Section 1. Section 1-510 of the Municipal Code of Rushville, Nebraska, is amended to read as follows: 

MEETINGS; GOVERNING BODY. The meetings of the governing body shall be held in the Council Chambers. Regular meetings shall be held on the last Monday of each month at the hour of six (6:00) o’clock P.M. Special meetings may be called by the Mayor or by three (3) Members of the City Council, the object of which shall be submitted to the counsel in writing. The call and object, as well as the disposition thereof, shall be entered upon the Journal by the Municipal Clerk. On filing the call for a special meeting, the Municipal Clerk shall notify the Council Members of the special meeting, stating the time and its purpose. Notice of a special meeting need not be given to a Council Member known to be out of state, or physically unable to be present. A majority of all of the Members elected to the City Council shall constitute a quorum for the transaction of any business, but a fewer number of Members may adjourn from time to time and compel the attendance of absent Members. The Mayor shall be deemed a Member of the City Council for purposes of establishing a quorum when the Mayor’s presence is necessary to establish the quorum. At the hour appointed for the meeting, the Municipal Clerk shall proceed to call the roll of Members and announce whether a quorum is present. If a quorum is present, the Council shall be called to order by the Mayor, if present; or if absent, by the President of the Council. In the absence of both the Mayor and the President of the Council, the City Council Members shall elect a President Pro Tempore.

Section 2. Any other Ordinance or Section passed and approved prior to passage, approval and publication or posting of this Ordinance and in conflict with its provisions are repealed. 

Section 3. This Ordinance shall take effect and be in full force from and after its passage, approval and publication or posting as required by law.
