City of Rushville City Council Meeting Rushville, Ne 69360 July 26, 2021

The meeting was called to order by Mayor Heiser at 6:00 p.m. as per the Municipal Code of the City of Rushville, Sheridan County, NE.  Notice of the meeting was given by publication in the Sheridan County Journal Star on July 21, 2021 as required by law and delivered to the Council in person. Present: Willnerd, Gilchrist,Janssen    Absent:  Haller

The following motions were duly made, seconded and passed.

A RESOLUTION OF THE CITY OF RUSHVILLE DIRECTING THE SALE OF THE FOLLOWING DESCRIBED REAL ESTATE TO ELISHA A. RISSE FOR A TOTAL PURCHASE PRICE OF FOUR HO-DRED DOLLARS ($400.00):

The North Sixty-five feet of Lot One (l), Block Forty-three (43), Talbot’s Subdivision of the City of Rushville, Sheridan County, Nebraska.

A RESOLUTION OF THE CITY OF RUSHVILLE DIRECTING THE SALE OF THE FOLLOWING DESCRIBED REAL ESTATE TO BARBARA A. RABELER FOR A TOTAL PURCHASE PRICE OF ONE HUNDRED DOLLARS 100.00):

 The South Fifteen feet of Lot One (l), Block Forty-three (43), Talbot’s Subdivision of the City of Rushville, Sheridan County, Nebraska.

WHEREAS the City of Rushville, Nebraska desires to sell the aforementioned piece of real estate more particularly described as Lot One (l), Block Forty-three (43), in Talbot’s Subdivision of the City of Rushville, Sheridan County, Nebraska; and

WHEREAS the members of the City Council ofthe City of Rushville, Nebraska find that the total fair market value of the aforementioned property is less than Five Thousand Dollars ($5,000.00); and

WTIEREAS the City of Rushville, Nebraska, hereby desires to sell the property to Elisha A. Risse and Barbara A. Rabeler pursuant to the procedures authorized by Neb.Rev.Stat. SS 17503.01 (R.R.S. 2012), as amended; and

NOW THEREFORE BE IT RESOLVED that the City Council of Rushville, Nebraska hereby directs the sale of the following real estate owned by the City of Rushville, Nebraska, towit:

Lot One (1), Block Forty-three (43), of Talbot’s Subdivision of the City of Rushville, Sheridan County, Nebraska;

BE IT FURTHER RESOLVED that the City Council offers and directs the sale of the

North Sixty-five feet of Lot One (1), Block Forty-three (43), Talbot’s Subdivision of the City of Rushville, Sheridan County, Nebraska, to Elisha A. Risse for a purchase price of Four Hundred Dollars ($400.00) pursuant to Neb.Rev.Stat. 517-503.01 (R.R.S. 2012), as amended, and pursuant to the terms and conditions of the sale as subsequently listed in the Notice of Sale posted pursuant to state statute;

BE IT FURTHER RESOLVED that the City Council offers and directs the sale of the

South Fifteen feet of Lot One (1), Block Forty-three (43), Talbot’s Subdivision of the City of Rushville, Sheridan County, Nebraska, to Barbara A. Rabeler for a purchase price of One Hundred Dollars ($100.00) pursuant to Neb.Rev.Stat. 517-503.01 (R.R.S. 2012), as amended, and pursuant to the tams and conditions of the sale as subsequently listed in the Notice of Sale posted pursuant to state statute;

BE IT FURTHER RESOLVED that following the passage of this Resolution directing the sale of the aforementioned property, notice of the sale shall be posted in three common places within the City of Rushville for a period of not less than seven (7) days prior to this sale of said property;

BE IT FURTHER RESOLVED that the notice shall give a general description of the property offered for sale and state the tenns and conditions of sale;

 BE IT FURTHER RESOLVED that said notice of sale shall be posted as aforementioned no later than August 2, 2021 ;

BE IT FURTHER RESOLVED that said offer of sale to the aforementioned individuals shall remain open only until the date mentioned in the notice of sale and shall be posted in three common places within the City of Rushville for a period of not less than seven (7) days prior to the sale of said property;

BE IT FURTHER RESOLVED that a majority of the voting members of the City Council find, by passage of this Resolution, that the aforementioned real property has a total fair market value which is less than Five Thousand Dollars ($5,000.00);

BE IT FURTHER RESOLVED that Resolution No. 2021-02 which was passed and adopted on the 28ff1 day of June, 2021, is hereby repealed in its entirety.

Kraig Petersen was present with updates from the Park Board.  He was wondering about non-residents of Sheridan County being allowed to serve on the Park Board.  He also noted that the restrooms seem to be out of paper most of the time.

There was discussion regarding the current Curb Stop Ordinance and how it should be handled if a curb stop is not working.  Kirk is going to look into pricing for a better locator to start working on locating all of the curb stops and finding out which ones are working or not.

Mayor Heiser brought up employee vacation time and stated that in the hand book it says that all employees must submit written notice to the Clerk’s Office 1 week prior to the leave.
